Terms of use

These terms govern access to and use of 360Claims as a professional platform for claims practices, independent adjusters, technical teams and authorized users.

1. Service owner

360Claims is operated by ByeByeBits, LLC, with registered address at 3424 SW 34th Ct, Topeka, Kansas, United States.

2. Service scope

360Claims is a SaaS platform for the operational management of claim files, communications, documentation, Claimy, visits, reports, billing, settlements and practice control.

The service is intended for professional users. It should not be interpreted as automatic legal, tax, technical or expert advice and does not replace the professional judgement of authorized users.

3. Account, users and access

Access to 360Claims requires an authorized account and, where applicable, an active subscription with the contracted number of licenses.

Each user must protect their credentials, keep them confidential and use the platform according to the permissions assigned by their organization.

The customer is responsible for managing users, roles, permissions and access, and for reporting any unauthorized use or security incident of which it becomes aware.

4. Permitted use

The customer agrees to use 360Claims for professional purposes related to its activity and to enter lawful, accurate, up-to-date and necessary information for case management.

The platform may not be used to access unauthorized information, interfere with the service, infringe third-party rights, upload unlawful content or perform uses that may compromise the security, availability or integrity of 360Claims.

5. Customer data and content

The customer retains ownership of the data and content entered into the platform. 360Claims processes it to provide the service, maintain operations, provide support and comply with applicable obligations.

The customer must have a sufficient lawful basis to add personal data, documents, communications, attachments or third-party information to the platform.

Personal-data processing is also governed by the privacy policy and, where applicable, the contractual conditions or data-processing agreements in force.

6. Claimy and artificial intelligence

Claimy is contextual assistance integrated into 360Claims. It may generate suggestions, summaries, drafts, reviews or proposals linked to the case file and operational workflows in the platform.

Claimy outputs must be reviewed by professional users before being incorporated into final work. Claimy does not replace the adjuster, does not remove professional review and must not be used as the sole basis for decisions with relevant legal, economic or technical effects.

The customer and its users are responsible for reviewing information generated or assisted by Claimy and deciding whether it is suitable for the specific case.

7. Communications and connected channels

360Claims may allow receiving, assigning, sending or managing communications and attachments linked to case files through email, WhatsApp, SMS or other connected systems.

The customer must ensure it has a sufficient lawful basis to communicate with insured parties, third parties, handlers or other data subjects, and to add those communications to the case file.

8. Billing, settlements and payments

360Claims may help prepare invoices, register statuses, structure settlements and organize economic information linked to the case file.

The platform does not execute bank payments to adjusters or third parties. Payment is made outside 360Claims, except for subscription services, payments or charges managed through the means enabled to contract the service.

The customer is responsible for reviewing economic, tax and administrative information generated or registered in the platform before using it in final operations.

9. VeriFactu and operational compliance

360Claims may include functionality related to electronic invoicing, VeriFactu or other applicable tax or operational requirements.

Correct configuration depends on each customer, its tax data, certificate, series, settings and billing workflow. Platform use does not replace any legal, tax or accounting advice an organization may need.

10. Trial and assisted implementation

New subscriptions may include a trial period according to the commercial conditions in force at each time.

Assisted implementation with a consultant is an optional paid service. Its scope, availability and price are communicated during the commercial or contracting process.

11. Intellectual property

360Claims, Claimy, their interfaces, text, structure, documentation, images, brands, designs and other service elements belong to their owners or licensors.

Use of the service does not grant the customer ownership over the platform, software, brand or protected elements of 360Claims, except for the contracted right of use.

12. Availability and changes

360Claims may evolve, modify, limit or expand its functionality to improve the service, adapt to technical requirements, maintain security or incorporate new capabilities.

Relevant changes will be communicated through the usual channels when they materially affect service use.

Although 360Claims works to maintain service availability and continuity, interruptions may occur due to maintenance, updates, technical incidents, external providers or causes beyond reasonable control.

13. Suspension or cancellation

360Claims may suspend or limit access where there is a breach of these terms, misuse, security risk, non-payment or justified technical need.

Subscription cancellation will be governed by the applicable commercial or contractual conditions. After cancellation, export, blocking, retention or deletion processes may apply according to the contract, privacy policy and applicable legal obligations.

14. Changes to these terms

360Claims may update these terms to reflect legal, technical, commercial or operational changes. The published version will state the latest update date.

When changes are relevant, they will be communicated by appropriate means or highlighted on the website or platform.
