2. Use of the Service

360Claims is a professional software intended for adjusters, firms, and insurance companies. You may only use the service if you have the legal capacity to enter into contracts and operate within the limits of the applicable laws in your country.
2.2. Licenses
Users require an active license to access the platform. Each license is personal, non-transferable, and must be used exclusively for its intended purposes (claim management and report generation).
2.3. User Responsibilities
You guarantee that the data you enter on the platform is accurate and up to date. You are responsible for protecting your account access credentials. Any misuse of the account will be your responsibility.
3. Collection and Use of Personal Data
3.1. Types of Data Collected
Adjuster data: name, email, phone number, and other professional information. Third-party data: names, addresses, descriptions of claims, photos of damages, attached documents, and any other data related to the case being managed.
3.2. Purpose of Data Processing
To manage claims and generate expert reports. To collaborate with insurance companies to assess and resolve claims. To store information securely to comply with audits and legal requirements.
3.3. Data Protection
Your data will be protected with appropriate technical and organizational security measures. In the event of security incidents that compromise your data, you will be notified in accordance with applicable laws.
4. Integration with Insurance Companies
360Claims allows integration with insurance companies' systems and processes to streamline claim management and communication between parties. This functionality includes the secure transfer of data, such as information about the claims, details of expert reports, and relevant updates to resolve each case.
The integration is designed to comply with privacy and data protection regulations applicable in each jurisdiction. It is the user's responsibility to ensure that the data provided through these integrations is truthful, accurate, and compliant with the relevant insurance companies' policies.
In the event of integration failures due to user errors or non-compliance with the conditions set by the insurance company, 360Claims is not responsible for any delays or issues arising from such failures.
5. Intelectual Property
All rights to the 360Claims platform, including designs, codes, features, and trademarks, are owned by ByeByeBits, LLC. It is not permitted to copy, modify, distribute, or use in any unauthorized manner elements protected by copyright or intellectual property laws.
6. Limitation of Liability
360Claims is a support tool for claim management and report generation, but the user is solely responsible for the quality, accuracy, and legality of the data entered and the decisions made based on it. We are not responsible for errors resulting from misuse of the platform or technical failures beyond our control.
7. Jurisdiction and Governing Law
This agreement will be governed exclusively by the laws of the state of Kansas, United States. Any disputes arising in connection with these terms or the use of the platform will be resolved in the state or federal courts located in Kansas. By using 360Claims, you agree to submit to the exclusive jurisdiction of those courts.
8. Modifications to the Terms
We may update these Terms and Conditions to reflect changes in the platform or applicable regulations. We will notify you of any significant changes via the platform or email.
